August Social Contest Terms & Conditions

Haircarebear/Australian Health Vitality “Spot & Win” Contest Terms and Conditions 

I (“Participant”) hereby confirmed that I have read, acknowledged my understanding, and agreed to be bound by the following Terms and Conditions: 

The Contest Period 

  1. The Haircarebear/Australian Health Vitality “Spot & Win” contest runs from 1st August 2023, at 00:00 and ends at 23:59 on 31st August 2023.
  2. HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY reserves the right upon giving adequate prior notice to change the duration and/or the commencement and/or expiry dates of the Contest Period.

Eligibility 

  1. This Contest is open to Malaysian citizens aged from 18 and above.
  2. The Organizer may at its sole and absolute discretion extend the Contest Period at any time without prior notice to any party (‘The Extended Period’). Unless an extended period is announced, any entries received after Contest period shall be treated as disqualified. Any participation in the Contest during this Extended Period (if any) shall be governed by these terms and conditions (“Terms and Conditions’) which shall remain in full force and effect.

Prizes & Participation Criteria 

  1. To participate in this Contest, the Participant will need to match the entry terms and conditions, announced via HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY official Facebook or Instagram page (Eligible Entries) as the following:
  1. Participant to LIKE & FOLLOW Haircarebear’s Facebook page or FOLLOW Haircarebear’s Instagram page. (Participants to decide on ONE social media platform they would like to participate on.) 
  1. Participants to comment how many gummies they can spot in Beary Land in the contest announcement post.   
  1. Participants to tag 3 Bearsties (friends).  
  1. Participants to share this post on their profile for Facebook or to share on Instagram Story for Instagram. 

 

  1. Participant may send more than one submission on their chosen social media platform. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
  2. Entrants into the Prize Draw shall be deemed to have accepted these Terms and Conditions.
  3. Participant may only participate via the comment section of the contest announcement post on HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY official Facebook or Instagram page.
  4. Participant must send in their submission by 23:59, 31st August 2023 (entries received after this date will not be eligible). 

 

Winner Selection Process 

  1. 10. Total of 6x Winners will be selected randomly from the submission received on Facebook and Instagram with the correct number of gummies. Prizes are as below:

2x Haircarebear Gummies of choice for each of the 3x Facebook winners. 

2x Haircarebear Gummies of choice for each of the 3x Instagram winners. 

11. Decision is final, and no correspondence will be entered into. 

12. The Winners will be notified by 7th September 2023 through the contest announcement’s comment section and will receive their prizes via postage. The Winners must provide their full name, phone number, MyKad number, email address, and postal address via DM. If a Winner does not respond to HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY within 3 days of being notified in the comment section by HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY, then the Winner's prize will be forfeited. If a Winner rejects their prize or the entry is invalid or in breach of these Terms and Conditions, the Winner's prize will be forfeited. 

  1. 13. It is the Participant’s responsibility to ensure their postal address and phone numbers provided are current and updated with HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY in the event of any changes being made to the same by the Shortlisted Further and for the avoidance of any doubt, HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY shall not be liable for any telco charges, roaming or phone charges which is to be borne by the Shortlisted Participants, whether in or outside Malaysia as a result of HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY contacting the Shortlisted Participants. HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY reserves the right to record these telephone conversations.

Prizes Terms & Conditions 

  1. 14. The Winner’s name of this prize as listed in the acknowledgement section is the authorized Winner of the prize. This prize is not redeemable for exchange with equivalent value.

General Terms & Conditions 

  1. 15. Organisers are not held liable for any health illness or injuries that may result before, during, and/or after your entry of the challenge
  2. 16. HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY reserve the right to publish or display the name, picture and city of residence of the Participants who won the prize(s) for this Contest for advertising and publicity purposes in any manner it deems appropriate. By participating in this Contest, the Winners hereby consent to and agree that HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY shall be at liberty to publish their names, pictures and city of residence without compensation for advertising and publicity purposes. Non-compliance may result in an alternative Winner being chosen.
  3. 17. By participating in this Contest, the Participant agrees to be bound by these Terms and Conditions and the decisions of HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY.
  4. 18. To the fullest extent permitted by law, HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY expressly exclude and disclaim any representations, warranties or endorsement, implied or express, written or oral, of all Prizes offered under this Contest. All risks, loss, damage and/or injury associated with the use of the Prizes shall be assumed by the Participants.
  5. 19. HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY will not entertain any complaint whatsoever in connection with the Prizes.
  6. 20. HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY shall be entitled to vary, delete or add to any of these Terms and Conditions or any part thereof and/or substitute or replace the Prizes offered under this Contest and/or to extend, modify, shorten, discontinue, cancel, terminate or suspend this Contest by giving adequate notice to Participants.
  7. 21. No compensation in cash, refund, replacement or any kind shall be given to the Participants for any losses or damages suffered or incurred by the Participants as a direct or an indirect result of such variation, deletion, addition or alteration of these Terms and Conditions and/or the extension, modification, cancellation, suspension or termination of this
  8. 22. Decision of HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY in relation to every aspect of this Contest shall be final, binding and conclusive.
  9. 23. HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY will not assume any responsibility for the Prizes offered under this Contest and accept no liability (including without limitation, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third party) howsoever arising whether in contract, tort, negligence or otherwise in connection with this Contest, even if HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY have been advised of the possibility of such damages in advance, and all such damages are expressly excluded.
  10. 24. By acceptance or receipt of a Prize, the Winner agrees to hold harmless HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY and its affiliates and their respective directors, officers, employees and agents from and against any claim, action, proceeding, judgment, damage, loss, expense or liability suffered by HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY and its affiliates and their respective directors, officers, employees and agents in connection with such Winner’s participation in the Contest or receipt, redemption or use of the Prizes.
  11. 25. HAIRCAREBEAR/AUSTRALIAN HEALTH VITALITY accepts no responsibility for any tax implications that may arise from the Prizes or the use thereof. Any tax filing obligation or any tax payment due to any authority as a result of receipt of the Prizes remain the sole responsibility of the It is the responsibility of each participant to seek independent advice on the possible implications this may have on his/her own financial situation.
